Terms of Service

1. Introduction

These Terms of Service govern your use of the Paint Manager software-as-a-service platform operated by Construction Estimating Software Ltd (Company No. 13128510), trading as Paint Manager. By accessing or using the service, you agree to be bound by these Terms.

2. Definitions

• Account means a unique account created for you to access the service.
• Subscriber means any individual or entity registered for an account.
• Content means data, text, files and information you input into the service.
• Subscription means paid access to the service under a selected plan.

3. Account registration

You must provide accurate information, maintain account security, notify us of unauthorised access and be responsible for activity under your account. You must be at least 18 years old to create an account.

4. Subscription and payment

Paint Manager offers free and paid subscription plans. Paid subscriptions are billed in advance monthly or annually in British Pounds. You may cancel your subscription at any time and retain paid access until the end of the current billing period.

Where you enable the optional Online Payments add-on and connect a Stripe account, Paint Manager may retain a platform processing fee of 0.5% of the gross invoice amount in addition to Stripe's own card processing fees.

5. Acceptable use

You must not use the service to violate laws, infringe rights, transmit harmful code, attempt unauthorised access, disrupt the service, perform automated data collection without permission or use the service for fraudulent purposes.

6. Your content

You retain ownership of content you input into the service. You grant us a limited licence to host, store and process your content solely to provide the service. You are responsible for the accuracy and legality of your content.

7. Intellectual property

The service, including its content, features and functionality, is owned by Paint Manager and protected by UK and international intellectual property laws.

8. Data protection

Your use of the service is also governed by our Privacy Policy, which explains how we collect, use and protect personal data under UK GDPR and the Data Protection Act 2018.

9. Limitation of liability

The service is provided as is. To the maximum extent permitted by law, our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim. Nothing excludes liability that cannot be excluded by law.

10. Termination

We may terminate or suspend accounts for breach of these Terms, fraudulent or illegal activity, non-payment, abuse of the service or abuse of other users.

11. Changes to Terms

We may modify these Terms and will provide at least 30 days' notice of material changes. Continued use after changes take effect constitutes acceptance of the new Terms.

12. Governing law

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
